Are Party Wall Agreements required by law?
Yes, Party Wall Agreements are required by law in certain situations under the Party Wall etc. Act 1996. If you plan to carry out building work that affects a shared wall, boundary, or structure between properties (known as a party wall), you must notify your neighbors (the adjoining owners). This includes work such as building a new wall, cutting into an existing party wall, or excavating near the boundary.
The adjoining owner has the right to agree or disagree with the proposed work. If they disagree or don’t respond, a Party Wall Agreement (or Award) must be drawn up by surveyors to resolve the dispute. Failing to comply with the Act can lead to legal complications and delays in your building project
